Below are the "Terms and Conditions" for the use, browsing, and purchase of Pink Diamond Products (hereinafter the "Products") on and through the pinkdiamondcostarica.com site or its direct link via Facebook (hereinafter the "Site") by users and/or customers (hereinafter the "Customer" or the "Customers").

Acceptance

Visiting our site and/or purchasing our products implies that customers are aware of and accept (without reservation) our "Terms and Conditions".

Modification

We reserve the right to modify the Terms and Conditions without prior notice. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website after the posting of any changes constitutes acceptance of those changes.

The prices of our products and shipping costs are subject to change without prior notice.

Personal Data

1. Pink Diamond informs that it operates legally, registered as a natural person, accrediting María Luisa Bonilla Varela, identification number 0304740418, as a taxpayer enrolled in the Traditional Regime.
2. All records with Customer information are made and stored solely for the purpose of arranging the sale of Products and for the security of the Customers themselves.
3. Pink Diamond will not provide the information given by Customers to third parties, unless a legal and/or judicial provision so indicates.

Computer Security

By accepting these Terms and Conditions, the customer declares that they are at least of legal age or have the authorization of their legal guardian.
The customer may not use our products for any illegal or unauthorized purpose, nor may they, in using our services, violate any law (including copyright laws).
The customer must not transmit any viruses or any code of a destructive nature, and must also have the necessary computer security tools to prevent possible damage to their property.
A breach or violation of any of the Terms will result in the immediate termination of your Services.

General Conditions

We reserve the right to refuse service to anyone for any reason at any time.
The customer understands that their content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to adapt to the technical requirements of connected networks or devices. Credit card information is always encrypted during transfer over networks.
The customer agrees not to reproduce, duplicate, copy, sell, resell or exploit any portion of our service, use of the service, or access to the service or any contact on the website through which the service is provided, without our express written permission.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Exclusion of Liability

Pink Diamond CR reserves the right to suspend and/or modify, totally and/or partially, permanently and/or temporarily, the operation of the site and its services, without prior notice.
Except for unforeseen circumstances or force majeure, Pink Diamond CR commits to fulfill services that were pending at the time of the site's operation suspension.
Pink Diamond CR contracts the services of Shopify and PayPal as providers and administrators of the computer system for the sale of products on the site.

Pink Diamond CR contracts the services of Correos de Costa Rica for the shipment of purchases that require transportation.

Products and Services

The prices of our products and shipping costs are subject to change without prior notice.

The prices of our products include the Acquired Sales Tax authorized in Costa Rica (13%).

The accepted payment methods are bank deposit, credit/debit card, or cash.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

No reservation and/or shipment of the Product will be made until the full payment for it is credited. Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We reserve the right to limit any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. We reserve the right to discontinue any product at any time. All product descriptions or product prices are subject to change at any time without prior notice, at our sole discretion. In the event that we make a change or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

Pink Diamond CR informs customers that the Product selected for purchase may not be in stock; for this reason, all purchases made and processed on the site are subject to actual product availability. In the event that the purchase of an unavailable product has been completed, Pink Diamond CR will contact the customer, who may choose one of the following options: (i) Continue waiting for the delivery of the product, unless it has been discontinued; or (ii) cancel the purchase operation and request a refund of the paid price; or (iii) choose an alternative product of equal characteristics and for the same value; if the Customer opts for one with better characteristics, they must pay the difference in value. The customer must use any of the options within fifteen (15) days after the communication sent by Pink Diamond CR. In case of silence, Pink Diamond CR may choose to cancel the purchase operation and issue a refund of the paid price.

We will ship products within the country through Correos de Costa Rica within an estimated time of 4 to 5 business days after the purchase is made. Once the product is dispatched, the shipping time and effective delivery will depend on the postal company. By purchasing our products, the customer accepts the courier service of Correos de Costa Rica. We commit to tracking the shipment, upon the customer's express request. The customer agrees to provide current purchase, account, and address information and will be responsible for any delays and/or additional costs that may arise from omitting and/or erroneously declaring the delivery address information at the time of purchase.

Customer Non-compliance

The customer agrees to use the site in a normal and responsible manner, according to browsing customs and practices, and not to use the site to harm: (i) Pink Diamond, its property rights, and/or the operation of the site itself; (ii) other Customers; and/or (iii) third parties in general. The customer must refrain from using the site as a means to infringe the law and/or perform acts of any nature from which any kind of damage to third parties could arise. The customer must provide all information required to complete a possible product purchase operation, truthfully and completely.

In case of non-compliance by the customer with any of the obligations referred to in these "Terms and Conditions", we reserve the right, at our sole option and discretion, to:

1. Cancel the Product purchase operation; and/or
2. Prohibit the Customer from using the Site; and/or
3. Report any violation of legal provisions to the relevant authorities; and/or
4. Initiate any legal actions deemed appropriate, in case of damage to Pink Diamond CR's property.
